Please read this page carefully. By submitting an order on this website you are agreeing to the terms that appear below which will apply to any purchase made via this web site either manually or online.

To shop with us, you must be eighteen years of age or over.

1. Purchase Contract:


1. This web site is operated by SA Organics Pty Ltd (from 1/10/15) trading as OrganicBox since 1/11/2009 ("OrganicBox", "SA Organics", "we", "us" or "our").  
 
2. All purchases made on this web site are governed by these Terms and Conditions. 

3. We sell goods only to end-user consumers, unless prior arrangements have been made. 
 
4. All goods are sold subject to the condition that they will not be re-sold or otherwise circulated without our prior written consent.

5. Payment for orders is currently through the PayPal Credit card or Debit Card or Direct Deposit.  Subscription customers who elect to pay via Credit Card are processed through eWay.
 
6. Once payment has been made a copy of your order will be emailed to you along with your paypal receipt.  Please check your spam folder if you do not receive a copy.

7. If paying by direct deposit please use the banking receipt as proof of payment and forward a copy to finance@organicbox.com.au or changes@organicbox.com.au

9. Once payment has been made, or a signed contract for payment has been made, or a commitment to make payment via Direct Deposit has been made, or payment via PayPal, Credit or Debit Card or Direct Deposit at this point the purchase contract has been made and we will supply the goods to you in accordance with your order and these Terms and Conditions.
 
10. If by some mistake a product is delivered to you in error that we know about we will contact you asking for either payment or to make arrangements to collect.  Similarly if we do pack an item in error we would appreciate your advising us of the error so appropriate arrangements can be made.  These arrangements could be payment, collection or we may offer these as a gift.
 
11. Any customer paying by Direct Deposit, or Credit Card that is declined, or any other payment method that fails, who fails to agree by sale terms and conditions to complete the payment transaction prior to delivery is advised that SA Organics Pty Ltd ~ Organicbox will apply a late payment and admin fee of $5.00 per week for every week the funds are not deposited after Organicbox has delivered food in good faith to said customer.  If monies are still outstanding after 3 weeks Organicbox will seek the services of our lawyer, small claims court or a debt collection agency to recover all outstanding monies owed.  All fees incurred by OrganicBox in hiring our lawyer, debt collection agency or seeking action through Minor Civil Action through the Magistrates Court of South Australia will be transferred to the account of the customer in each individual case, also including the costs incurred in delivery the food to the non-paying customer.  Organicbox is not liable for any fees incurred in the cost of recovering monies due for non-payment of delivered boxes. ** Please do not place an order if you do not have the money to pay for it **
 
12. All customers who order or recieve food from OrganicBox will automatically be added to our database.  We will add your email address, christian and surname details only to our mailing list to receive newsletters and special offers.  If you no longer wish to receive communications from OrganicBox you have the option to unsubscribe.
 

2. Price and Delivery Charges:

1. The price of the goods will be as quoted on the web site at the time you confirm your order (by clicking the "Pay Now" button).
 
2. If you subsequently amend your order, the prices charged will be those applicable to the amended item(s)at the time that the amended order is confirmed.  
 
3. If an order is placed and then items ordered are not available or removed from the price list the customer will be refunded the difference in the price.
 
4. Contents and Weights listed in boxes are a guide only and may be changed pending final produce availablity.  We may go over weight with one product and slightly under with another but the boxes are worked out on price and you will always receive the same value in your box.
 
5. All orders created by customers as a custom order will be supplied as per the ordered weight and we will always aim to go over.  Any produce not supplied with either be substituted for a like product or we will issue a refund.
 
6. Depending on produce available we may in some instances increase the amount of some items to cover for a shortage in other area's eg 1kg parsnips may not be available so we may give you 1.5kg carrots.  In all cases we will strive to ensure your box is of the same quality and value for money.
 
7. Where items are ordered and sold individually by weight (such as fruit, vegetables and dry goods) the price of these items will be the price on the date you place your order.The prices stated on the website will be inclusive of any GST payable.
 
8. We have a standard flat charge of $9.90 (including GST) on all orders in areas Metro Adelaide, Greenock and the Barossa, through to Mt Barker and Seaford.  Orders beyond Seaford are $11.00 (including GST). Riverland transport is $20 (including GST). Port Lincoln and other country towns are generally $15 (including GST) but some may be higher in which case we will issue a separate invoice for freight.  Customers outside these areas are sent via Transport where available and individual prices apply.  Please email to find out about a delivery charge to your area.  If you continue to purchase from us we will ask you to add this delivery fee to all ongoing orders.
 
9. Items that have been ordered but can not be supplied on the day (often due to delivery delays, weather conditions that can destroy crops, public holiday closures affecting delivery) will be substituted at the discretion of Organicbox or a Refund will be issued.  

10. All customers are asked to advise if they do not want substitutions. 
 
11. Any refunds provided at the discretion of OrganicBox will be issued in via the same payment method eg  PayPal, PayPal Credit Card interface or Direct Deposit.  We will contact you for your bank details if you paid by Direct Deposit.  Refunds will be issued as soon as possible.

12. Seasonal boxes can be amended up to 2-3 items upon request if you have allergies or dislikes - just make a note in the comments box at time of purchase. 
 
13. Minimum order is $40.00 (excluding delivery fee).

14. SA Organics and OrganicBox meat, chicken, fish orders are subject to the following terms of sale:
1. Once delivery has been made by Organicbox the buyer assumes all responsibility for the meat and agrees that Organicbox are not responsible or liable for any defrosting or deterioration of the product.   (We recommend soOrganicbox will take all duty of care to deliver your meat professionally packaged and frozen.  meone is home to receive the order).
2. The buyer also agrees to return any ice packs provided either at the time of delivery or on return of the empty box as part of the next order.
3. If for any reason you no longer wish to order from Organicbox we would appreciate if you can make arrangements for us to collect the foam box, and we will refund your box deposit money.  
4. By completing your order through to PayPal you are agreeing to the terms above.
5. Organicbox will take all duty of care to deliver your meat professionally packaged and frozen. 
6. Once delivery has been made by Organicbox the buyer assumes all responsibility for the meat and agrees that Organicbox is not responsible or liable for any defrosting or deterioration of the product.   (We recommend someone is home to receive the order).
7. The buyer also agrees to return any ice packs provided either at the time of delivery or on return of the empty box as part of the next order, unless they purchase the ice packs.
8. If for any reason you no longer wish to order from Organicbox we would appreciate if you can make arrangements for us to collect the foam box and ice pack, and we will refund your box deposit money.   - SA Organics/Organicbox agree to work with all customers in relation to meat quality but firmly believe that once you try our beef you will be extremely happy with the quality of our Grass Fed, Hormone Free beef. 
9. By completing your order through to PayPal you are agreeing to the terms above.
 

3. Alcohol Sales:

1. SA Organics Pty Ltd Liquor License No. 57710478 
 
2. Customers must be 18 years or older to purchase alcohol.
 
3. You must provide your Date of Birth when purchasing alcohol via our website
 
4. You must provide 'Authority to Leave' for delivery of alcohol when purchasing through our website.
 
5. We will only deliver to the person who purchased the alcohol, or to an adult person nominated by the purchaser and in accordance with the instructions of the purchaser, such as providing "Authority to Leave" for us to deliver and leave the alcohol unattended.

4. Methods of Payment: 

1. Payment may be made by Direct Deposit (EFT), Credit Card or the Paypal interface. 
 
2. You CAN NOT pay for your order by COD - cash or cheque. 
 
3. Authority for payment will be requested from your card issuer at the time of your order. We reserve the right to terminate our agreement with you if we are refused authority for payment at any stage.
 
4. You agree to indemnify us in full against all costs expenses and outgoings incurred by us in obtaining payments from you in the event a failed payment occurs. This will include an administration charge.
 
5. We may at any time after a failed payment has occurred ask a debt collection agency to collect payment from you or seek the services of our Lawyer to recover payment from you.
 
6. 5. Delivery:

1. Delivery will be made to the address specified by you when you submit your order or have an account created. 
 
2. We reserve the right to restrict deliveries in certain areas, and this includes the right to eliminate certain areas from our delivery schedule altogether.
 
3. Produce is subject to availability and prevailing weather conditions. The website is updated on a regular basis but in the event of non-availability of any goods you order, we may offer a reasonable substitute around the same price or weight or a refund - refunding or substitution is at the discretion of Organicbox.  Please advise when ordering if you do not want substitutions.  
 
4. We will always strive to send the best of the best produce, but please take into account the nature of organics and the possibility of human error when packing.  Fruit and vegetables are fragile so Organicbox is happy to replace any produce you are not happy with in the following weeks order. Please let us know immediately if you are not happy with any items in your boxes. 
 
5. We are currently delivering on Tuesday, Wednessay and Thursday. 
 
6. Orders must be placed by midnight Sunday nights each week for delivery in the same week.
 
7. Any order placed after Monday evening will be assessed for delivery that week.  We will only send it if it can fit in our delivery schedule for that week.
 
8. Any order that we can not fit into delivery that week will be placed on "Backorder" to be delivered on the next due delivery day for your area.
 
9. Please note that on weeks where a public holiday falls on the Monday or Tuesday our days will be pushed out by one eg delivery Wednesday, Thursdays and Friday.
 
10. At time of order please advise us of a safe, secure, cool (if possible) place for us to leave the box if you will not be home to accept delivery.   The boxes will keep your produce cold on the hottest of days - they are esky's.  In summer the boxes may also be packed on ice.
 
11. Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or cancelled delivery. If that is the case we will endeavor to contact you as soon as we are able to in order to advise the new delivery day. 
 
12. We are happy to deliver to your work if it is more convenient, or if you are concerned for your box not being able to be secure or left in a cool spot.  If possible we would still like to collect your spare box but if not we will collect two on the following order.
 
13. Boxes all have lids which are a tight fit, in some cases as needed they will be sealed with tape.

6. Defective Goods:

1. We only aim to send out the best quality produce, fruit and veg are fragile, particularly organics so if for any reason you are not happy with an item in your box, email us straight away to let us know and we will send that item out to you again in your next order.
 
2. We offer a 100% replacement policy on any items you are not happy with.
 
3. Regarding Dairy or Dry Goods if you are at all unhappy with the quality, please contact us immediately and we will work out together the most suitable course of action.  Action could be a replacement item or a refund of the item.

7. Ordering:

1. Orders must be submitted by Sundays nightst at midnight, we are flexible so if you get it in Monday morning that is fine too.  
 
2. Orders placed after 5pm on Monday will be assessed for delivery that week - if we can not fit the order on our schedule it will be sent out the following week and you will be notified that your order is on "Backorder".  
 
3. Please remember to advise us of the location to leave the box if you will not be home, and of any items you are allergic to.  Also please remember to leave out your empty box.
 
4. Please email any notices, substitutions, swaps or order information to changes@organicbox.com.au

8. Refunds and Unavailable Produce/Products:

1. We aim to supply all items that are listed in the shopping cart, but due to the nature of organics and also the restraints of our current system, sometimes items do not arrive when ordered and we only find out on Monday or Tuesday that we will not have the produce.  Obviously this is upsetting for us because we want to supply your full order, and we know it is disappointing for you as you are expecting your full order, but we just have to manage it as best we can. 

2. We will often aim to provide a like substitute when possible eg desiree potatoes will be swapped with sebago etc etc but we will not swap potatoes with parsnips.......if you do not want substitutes at all please make a note on your order page.

3. All items will be refunded to you in full. We aim to process refunds Wednesdays or Thursdays where possible.  Refunds will be issued via the same system you paid with eg if you paid with PayPal we refund to PayPal.  So if you are using PayPal to order please make sure you are a verified PayPal user, as the money will go straight back into your account and can be used immediately.  If you pay by Direct Deposit we will email you to ask you to send in your account details so we can bank transfer to you.
 
4. We are not a large supermarket or grocery store so we carry limited stock of grocery lines, diary, dry goods so once those items are sold out we do not have the ability to restock immediately so if you order a larger amount than we have we will refund you or as per our T's & C's send a replacement item unless you specify "No Substitutes" on your order.

5. If you do not get a refund for an item that was missing in your box please contact us asap, and we will follow it up for you.  

9. Warranty and Liability:

1. Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, neither will any of these terms restrict any of your statutory rights.
 
2. In addition to paragraph 4.4 we will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.
 
3. Our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.
 

10. Customer Complaints

1. Any Customer complaints should be addressed to us via the e-mail address = changes@organicbox.com.au or the telephone numbers of which are listed below or on our website on the "Home Page" or "About Us" page.

11. General

1. If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
 
2. All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us.
 
3. These Terms and Conditions will be governed by South Australian law and the parties submit to the exclusive jurisdiction of the South Australian courts in relation to any dispute which may arise between them.
 
4. We keep your details private and will never share them with anyone.
 
5. SA Organics Pty Ltd and OrganicBox is a South Australian family owned and operated small business.
