Terms and Conditions of Sale

Please read this carefully. By submitting an order on this web site you are agreeing to the terms that appear below which will apply to any purchase made via this web site either manually or online.

To register with and shop with us, you must be eighteen years of age or over.
  1. Purchase Contract
    1. This web site is operated by OrganicBox.com.au ("we", "us" or "our").  All purchases made on this web site are governed by these Terms and Conditions.
    2. We sell goods only to end-user consumers. All goods are sold subject to the condition that they will not be re-sold or otherwise circulated without our prior written consent.
    3. Payment for orders is currently through the PayPal interface or the manual order system via Direct Deposit.  Once payment has been made a copy of your order will be emailed to you along with your paypal receipt.  If paying by direct deposit please use the banking receipt as proof of payment, a copy of the order can be saved online or in email.  If paying by Direct Deposit (Organicbox; BSB-105159; A/C-025894640; Ref-customer surname) please email us a copy of your payment to vanessa@organicbox.com.au.  Once payment has been made via PayPal or Direct Deposit at this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.
    4. You must be 18 years old or over and must have completed the registration process in order to participate in our service.
    5. If by some mistake a product is delivered to you in error that we know about we will contact you asking for either payment or to make arrangements to collect.  Similarily if we do pack an item in error we would appreciate your advising us of the error so appropriate arrangements can be made.  These arrangements could be payment, collection or we may offer these as a gift.
  2. Price and Delivery Charges
    1. The price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the "Pay Now" button). If you subsequently amend your order, the prices charged will be those applicable to the amended item(s)at the time that the amended order is confirmed.  If an order is placed and then items ordered are not available or removed from the price list the customer will be refunded the difference in the price.
    2. Weights listed in boxes are indicative only of approx quantities and to be used as a guide to what is in the boxes, we will always aim to pack over weight rather than under weight but in some instances it may be a little below for example broccoli can not be cut so it is usually a lot over weigh.  Depending on produce available we may in some instances increase the amount of some items to cover for a shortage in other area's eg 1kg parsnips may not be available so we may give you 1.5kg carrots.  In all cases we will strive to ensure your box is quality and value for money.
    3. Where items are ordered and sold individually by weight (such as fruit, vegetables and dry goods) the price of these items will be the price on the date you place your order.
    4. The prices stated on the website will be inclusive of any GST payable.
    5. We do not charge a delivery fee for orders in our designated delivery area but have a Fuel Levy charge of $3.50 on all orders.  Current delivery area is from Greenock through to Mt Barker to Aldinga Beach and everywhere in between.  Customers outside these areas are sent via Transport and individual prices apply.  We currently deliver to Bordertown, Mannum, Mt Compass, Encounter Bay and Roxby Downs.  Please email to find out about a delivery charge to your area.  If you continue to purchase from us we will ask you to add this delivery fee to all ongoing orders.
    6. Items that have been ordered but can not be supplied on the day (often due to delivery delays, weather conditions that can destroy crops, public holiday closures affecting delivery) will be substituted at the discretion of Organicbox or a Refund will be issued.  All customes are asked to advise if they do not want substitutions. Refunds will be issued in PayPal, generally within 3-4 days of delivery.
    7. Boxes purchased at the "Buy Now" price are not changeable.  If you wish to change items you will need to purchase the box by selecting "Add to Cart", this forfeits the "Buy Now" price but does give greater flexibility to add or remove items from your box.  You can also purchase a box at "Buy Now" price and then place a "build your own box" for any additional items.  If accompanied by a standard box the build your own has no minimum order.  If you "Build Your Own Box" minimum order is $30.
    8. Dairy milk orders associated with the Share Cow program are only delivered if accompanied by a Fruit and Veg order, otherwise it can be collected directly from the cold room.  Please email vanessa@organicbox.com.au for details or call 1300 833 998.
    9. KCA meat orders are subject to the following terms of sale:
      • Organicbox will take all duty of care to deliver your meat professionally packaged and frozen (time and temperature at delivery will be recorded).  Once delivery has been made by Organicbox the buyer assumes all responsibility for the meat and agrees that Organicbox are not responsible or liable for any defrosting or deterioration of the product.   (We recommend someone is home to receive the beef).
      • The buyer also agrees to return all ice packs provided either at the time of delivery or in the returning of the empty boxas part of your next order, and if for any reason you no longer wish to order from Organicbox it is your responsibility to return the foam meat box and ice pack to Organicbox.  If for any reason the foam box and ice pack are not returned the customer agrees to receive an invoice for payment for these items from Organicbox, after 3 weeks of no ordering.  Organicbox together withKenton Creek Angus agree to work with all customers in relation tomeat quality but firmly believe that once you try KCA beef you willbe extremely happy with the quality of our Grass Fed, Hormone Free Black Angus beef.  By clicking "Continue" or "Pay Now" you are agreeing to the terms above.
  3. Methods of Payment
    1. Payment may be made by debit, credit or charge card or direct deposit through our paypal interface. Or if manually ordering you can pay Direct Deposit.  Payment for manual orders must be made at time of order, with a copy of your payment receipt forwarded to info@organicbox.com.au.  You cannot pay for your order by cash or cheque.
    2. Authority for payment will be requested from your card issuer at the time of your order. We reserve the right to terminate our agreement with you if we are refused authority for payment at any stage.
    3. You agree to indemnify us in full against all costs expenses and outgoings incurred by us in obtaining payments from you in the event a failed payment occurs. This may include an administration charge. We may at any time after a failed payment has occurred ask a debt collection agency to collect payment from you.
  4. Delivery
    1. Delivery will be made to the address specified by you when you register on the website. We reserve the right to restrict deliveries in certain areas, and this includes the right to eliminate certain areas from our delivery schedule altogether.
    2. Produce is subject to availability and prevailing weather conditions. The website is updated on a regular basis but in the event of non-availability of any goods you order, we may offer a reasonable substitute around the same price or weight or a refund - refunding or substitution is at the discretion of Organicbox.  Please advise upon ordering or registration if you do not wish for substitutions.  We will not change any items from the Dry Goods box or the Dairy box.
    3. We will only aim to send the best of the best produce.  As fruit and veg is fragile we are happy to replace or refund produce where applicable, please advise immediately if you are not happy with any items in your boxes.
    4. We are currently delivering on Wednesdays, we will add in a Monday delivery if needed and as the business grows.  At the time of order you need to advise a safe, secure, cool (if possible) place for us to leave the box if you will not be home to accept delivery.   The boxes will keep your produce cold on the hottest of days - they are esky's.  Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or cancelled delivery. If that is the case we will endeavour to contact you as soon as we are able to in order to advise the new delivery day. 
    5. We are happy to deliver to your work if it is more convenient, or if you are concerned for your box not being able to be secure or left in a cool spot.  If possible we would still like to collect your spare box but if not we will collect two on the following order.
    6. Boxes will all have lids which are a tight fit, in some cases as needed they will be sealed with tape.
  5. Defective Goods
    1. We only aim to send out the best quality produce, fruit and veg are fragile, particularly organics so if for any reason you are not happy with an item in your box, email straight away so we can address the situation and offer a solution eg replacement or refund.
    2. In relation to Dairy items or Dry Goods items, if you are at all unhappy with the quality, please contact us immediately and we will work out together the most suitable course of action.  Action could be a replacement item or a refund of the item.
  6. Orders
    1. Orders must be submitted by Sunday Midnight for inclusion in our Wednesday Delivery run.  Please remember to advise us of the location to leave the box if you will not be home, and of any items you are allergic to.  Also please remember to leave out your empty box.
  7. Warranty and Liability
    1. Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, neither will any of these terms restrict any of your statutory rights.
    2. In addition to paragraph 4.4 we will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.
    3. Other than as set out in clause 7.1, our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.
  8. Customer Complaints
    1. Any Customer complaints should be addressed to us via the e-mail address and telephone numbers of which are listed on our website on the "Contact Us" page.
  9. General
    1. If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
    2. All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us.
    3. These Terms and Conditions will be governed by South Australian law and the parties submit to the exclusive jurisdiction of the South Australian courts in relation to any dispute which may arise between them.
